I, Alfred Porter, Jr., as President of BBCI, I was in court and actually witnessed Judge Gaul, on two straight days, refuse to allow the prosecutor to drop all charges in the case of Sheila McFarland. By not dropping the charges, I feel incensed that I witnessed two days of extra taxpayer money going towards witnesses, extra courtroom procedures and now more money going to house an inmate that shouldn’t be in jail. The prosecutors felt they didn’t have a case against Sheila McFarland, but she’s still in jail. She’s been held for over a year on an empty case.
The family will appear on the Voice It radio program today at 5 pm. Please help us right this travesty of justice.

Robert Pettway died in a bloody manner on East 108 & Olivet. Nine bullets riddled his body. His children and family are so angry and distraught about the violence in all of our neighborhoods. Violence and gun fire rang out on this street. This family says they are not scared any more. They are having a special family and neighborhood candlelight for Mr. Pettway.
However, this is much more. This family and the community want to send a message about the devastation and loss of life and property happening to so many people. This family is fed up. The community is fed up.

Distraught father, Danien DeFreeze, is joining the movement against spending tax money at the Q and downtown until money is spent in the neighborhoods.
Mr. DeFreeze has been called to action by the death of his precious daughter, Alianna. He is asking everyone to come out and support him, his family and others as they rally and protest in front of the Q demanding that city hall stops draining support from the neighborhoods.
Mr. DeFreeze is asking protesters to make their own signs relating to this matter and join him in front of the Q remembering that his daughter lost her life in a dilapidated neighborhood. Money should be spent tearing down houses that can’t be fixed, rehabbing those that can be saved and creating jobs for money to do the rehab process, making landlords keep their properties up to code, etc.

Outrageous court actions

The family of Ms. McFarland came to Black on Black Crime, Inc. a while ago because of their concerns about the unjustified jailing of Ms. McFarland for over a year without any actions being taken on any alleged charges. The trial finally started on Monday of this week. Members of BBCI have attended court proceedings and have seen and heard testimony in court that was ignored and overruled/rejected by the court which included statements made that Ms. McFarland was not present or involved in the alleged crime. The members of BBCI also heard many disparaging comments from the bench about Ms. McFarland, her family and friends.
Attached is a letter from Taneka McFarland, daughter of Ms. McFarland, further outlining their concerns over the actions of Judge Gaul, rulings he has made, and his unwillingness to allow testimony into the record.
Thank you for your attention to this outrageous situation in this courtroom. It isn’t the first and unfortunately probably won’t be the last.

To Whom It May Concern:

I would like to address racial acts from Judge Daniel Gaul. I noticed from several previous cases that he does not favor Black Americans. Judge Gaul was sanctioned by the Supreme Court for violating the Code of Judicial Conduct during a trial he presided over in 2007. He received a six-month suspension on his license and still remains on the bench. This is not the only time Judge Gaul has been reprimanded for his behavior.

In 2016, I attended the Eddie Brown lee case proceedings. Judge Gaul stated, “The only way you will survive this is if you leave out of prison in a body bag.” That was the most repulsive comment I have ever heard. There are a number of witnesses who can testify this.

My mother, Shelia McFarland, is currently on trial for conspiracy in the murder of Robert Williams, who died on November 14, 2015. During the hearings this past week, both the prosecutor and the defending attorneys agreed to dismiss the case due to lack of evidence that Ms. McFarland played an active role in this murder. The judge overruled and would not allow them to dismiss the charges on two consecutive days. Ms. McFarland requested that Judge Gaul recuse himself from the case several times. Yet again, he dismissed the request.

I am asking that you please look into this case. I am certain that you will find that the circumstances of this case are based upon bias, prejudice, and racism, including rulings from Judge Gaul.

The organization that has marched many times against the police department on various issues, is join with the family and others to praise the police in the timely and appropriate way they brought the alleged killer of Alianna DeFreeze to justice. It is a great victory for the community and the police that this vicious individual was taken off the street. We needed this quick result.
Ariel Bell, the spokesperson for the family, along with others, will march with us to the Fourth District to give accolades to the department. We urge others who were coming to the original march in the street to join us as we move forward.
For those who still want to bring teddy bears to cover as much of the house where Alianna was murdered, we will still go to the house for a prayer and memorial.

Hello, my name is Ariel, spokesperson for the family of Alianna DeFreeze (14). We will hold a press conference and candlelight vigil on Saturday, 2.4.17, at 3:30 pm, on the corner of East 93 & Kinsman (near the gas station). I will speak for the family, along with a few others. The family is going through a lot right now but they are inviting everyone to come and stand with them in honor of Alianna DeFreeeze.
If you are outraged at the brutal murder of this beautiful child, come and stand with us.
If you are tired and angry about the murders in our streets and neighborhoods, come stand with us.
If you have been a victim of violence or know someone who is a victim, come stand with us.
We are asking for all of Cleveland to come and stand with us.
Bring teddy bears so we can cover the entire house where Alianna lost her life so we can let her know we love her and we are showering her with love. We will never forget what happened to her in that evil house as we pray for justice not only for her but for all the women who are victims of the violence from the serial killer hiding and operating in the killing fields of East 93 Street.
